Terms of Service & Public Data Delivery SLA

1Acceptance of Terms & Service Scope

These Terms of Service ("Terms") constitute a legally binding agreement between you or your entity ("Client", "you") and MaaTech Analytics Solutions ("MaaTech Analytics", "we", "our", "us"), governing your access to our website, data extraction pipelines, custom API endpoints, datasets, and related engineering services.

By visiting our website, requesting a data sample, or executing a Statement of Work (SOW), you confirm that you have read, understood, and agreed to be bound by these Terms and our companion Privacy Policy.

2Publicly Available Data Guarantee & SLA

MaaTech Analytics specializes in extracting, structuring, and aggregating data that is publicly exposed on the internet. We operate strictly within the bounds of international public data law:

• Strict Public Web Focus: We only crawl and deliver data from pages, public search catalogs, open directories, product pricing tables, and public listings that require no authentication or password to view.
• No Authentication Bypass: We do not accept assignments to circumvent user logins, crack security tokens, bypass paywalls, or scrape private user account dashboards.
• No PII Harvesting: We do not systematically scrape, harvest, or aggregate sensitive Personal Identifiable Information (such as government IDs, payment cards, personal medical files, or private passwords).

3Client Representations & Lawful Use

When engaging MaaTech Analytics, the Client explicitly warrants and represents that:

• The requested data targets and extraction parameters serve a lawful business purpose (e.g. competitive pricing, catalog aggregation, market sentiment analytics, business intelligence).
• The Client will use delivered datasets in strict compliance with applicable regional data protection laws (including GDPR, CCPA, and India DPDP Act 2023).
• The Client will not use delivered datasets for spamming, harassment, illegal surveillance, fraud, or anti-competitive market manipulation.

4Prohibited Uses & Scraping Restrictions

MaaTech Analytics reserves the absolute right to reject or immediately terminate any project or API key without refund if the service is used for:

We pride ourselves on institutional-grade data engineering:

• 99.8% Schema Accuracy SLA: Delivered data is cleaned, validated, deduplicated, and tested against the exact JSON/CSV/SQL schema agreed upon in your SOW.
• 24-Hour Sample Turnaround: Initial proof-of-concept extractions and feasibility validations are typically configured within 24 business hours.
• Maintenance & Website Structure Changes: Target websites frequently update their DOM layouts. Our managed service includes continuous scraper maintenance to quickly adapt to upstream markup shifts.

6Intellectual Property & Deliverable Ownership

Client Ownership of Output: Upon full payment of agreed invoices, the Client owns the structured datasets, custom delivery schemas, and custom analytics generated specifically for their account under the SOW.

MaaTech IP: MaaTech Analytics retains all rights, title, and interest in and to its underlying core scraping engine, proxy rotation algorithms, anti-bot orchestration software, and proprietary AI parsing frameworks.

7Confidentiality & Non-Disclosure

We treat all client target parameters, business strategies, API endpoints, webhook URLs, and proprietary schema definitions with strict commercial confidentiality. We will never sell, lease, or disclose your extraction targets to third parties or competitors.

8Pricing, Payments, Subscriptions & Refunds

• Invoicing: Payment terms are net 15 or 30 days as specified in your contract. Periodic pipelines (hourly, daily, monthly) are invoiced at the commencement of each billing cycle.
• One-Time Projects: Setup fees and pilot batches are due prior to final production delivery.
• Refund Policy: Because custom extraction pipelines require dedicated engineering, cloud proxy infrastructure, and server compute, fees are non-refundable once extraction batches are processed and delivered according to agreed specifications.

9Warranty Disclaimers & Limitation of Liability

While we guarantee 99.8% schema parsing accuracy, public internet data is delivered on an "AS-IS" and "AS-AVAILABLE" basis. MaaTech Analytics is not responsible for inaccurate source content published by third-party target websites.

To the maximum extent permitted by law, MaaTech Analytics shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use of the extracted data.

10Indemnification & Third-Party Platforms

The Client agrees to defend, indemnify, and hold harmless MaaTech Analytics and its officers against any claims, liabilities, damages, or expenses arising from the Client's breach of these Terms, unlawful downstream usage of datasets, or violation of third-party intellectual property rights.

11Governing Law & Jurisdiction (Vadodara, India)

These Terms and all disputes arising out of or related to our services shall be governed by and construed in accordance with the substantive laws of India, without regard to conflict of law principles. The competent courts located in Vadodara, Gujarat, India shall have exclusive jurisdiction over any legal proceedings.
